Man to be indicted on new charges for crash that killed Merrick crossing guard

The man accused of driving high and killing a Nassau County crossing guard is going to be indicted on new charges.

Joshua Alvarado will face three additional charges, including manslaughter, for the death of John Miro, court records show.

As News 12 has reported, the 30-year-old Queens man was driving under the influence of drugs when he hit the 70-year-old crossing guard on Sunrise Highway, prosecutors say.

Miro was on the job helping people cross the street near the Merrick train station at the time of the crash on Feb. 26.

Alvarado admitted that he took Xanax, Tramadol and Clonazepam, according to court documents.

His attorney says he was taking the prescriptions for PTSD.

The victim was in critical condition for days before succumbing to his injuries at the hospital.

Fellow crossing guard Donna Partland remembered him as a "sweetheart" and a "staple of the community."
