A man who reported an alleged sexual assault on a minor by a Clarkstown High School North janitor spoke exclusively to News 12 to detail his claims that he was retaliated against for coming forward.

According to the lawsuit filed against the Clarkstown school district, Carlos Martinez claims he was retaliated against after helping a cafeteria worker report sexual misconduct by a district security guard. Martinez, a former undercover officer for the NYPD, said that the alleged victim told him that the staff member “touched her butt."

The lawsuit also alleges that same security guard had unwanted sexual contact with an underage student at Clarkstown High School North. Martinez claims the district only suspended the employee for 30 days and then rehired him at Clarkstown High School South.

Martinez claims that the district seemed to punish him for coming forward by transferring him and giving him poor evaluations. Martinez says that he had no other option than to sue the district.

He says he was an NYPD member during the Sept. 11 terror attacks, and that district made it hard for him to get his medical checkups.

"They wanted doctor’s notes, they wanted documentation, they wanted to limit my days of going,” he says.

The district declined News 12’s request for an interview, saying it's their policy not to discuss pending litigation. The superintendent’s office released a statement saying that the “district disagrees with the statements in recent news reports and is committed to providing a safe learning and working environment for our students, faculty, and staff."
