The man at the center of a Yonkers police brutality case will spend the rest of the week behind bars due to a mix-up with lawyers.
Eric Brown, 28, is charged with resisting arrest, disorderly conduct and felony assault after he allegedly became combative with police. Officers say the entire incident began when they tried to issue Brown a summons for not cleaning up after his dog. Brown appeared in Yonkers City Court twice Wednesday. Both times the private attorney that has been hired by the NAACP was not able to be in court. Brown was due to have a felony hearing scheduled for Thursday. However, he will now have to wait until Monday.
Police say Brown refused to produce identification or accept a summons and became belligerent on Friday. They also say he has an arrest record that includes several other similar charges, including fighting with officers. However, witnesses at the scene say Brown was unfairly beaten and called racial slurs by police. The entire incident was caught on tape.
Brown spent the night in jail Tuesday after he appeared in court without his lawyer. Wednesday, Legal Aid attorneys said they couldn?t take over Brown?s case if a private attorney was slated to represent him. Finally, the judge asked another lawyer to stand with Brown. However, that lawyer recommended Brown wait for his own attorney who is supposed to appear on Monday. Until then, no bail has been set and Brown remains in jail.
