A City of Kingston police sergeant has now pleaded guilty to disorderly conduct following his arrest for drunk driving.
Eric VanAllen, 46, accepted the plea deal in Town of Gardiner Court on Wednesday, according to the special Ulster County prosecutor on the case, Michael Pollok.
The charge was reduced from a misdemeanor to a violation and requires VanAllen to obtain alcohol treatment and attend a victim’s impact panel, according to Pollok.
The sergeant was arrested for DWI by state police while off duty in December after he was found in his pickup truck “seemingly asleep” at the wheel in Gardiner.
The court official says VanAllen’s blood alcohol content was 0.10 and that he was “treated like any other person” with a first offense and “low BAC.”
The incident sparked renewed interest in a highly publicized rollover crash involving VanAllen in 2013 that prompted an anonymous letter alleging a police cover-up and calls for a probe into law enforcement actions during the investigation.
VanAllen is currently suspended from the City of Kingston Police Department and has voluntarily sought outpatient treatment since his arrest, according to Pollok.
News 12’s calls to VanAllen, the City of Kingston Police Department and mayor for comment were not immediately returned.
