The Yonkers police officer accused of throwing a woman to the ground appeared in a White Plains courtroom Thursday.
Officer Wayne Simoes and his lawyer asked a judge at the federal courthouse to dismiss or review the indictment against Simoes. The judge dismissed the request and the police officer's trial is expected to begin May 11.
The alleged incident involving Simoes and Irma Marquez, 44, happened in March of 2007 at La Fonda Restaurant, when police were called to the eatery after Marquez's niece was knocked unconscious by a bottle in a bar fight.
When Marquez tried to approach her niece as emergency workers were attending her, Simoes allegedly picked her up and slammed her to the tile floor face first.
