A federal appeals court has upheld the decision to dismiss a discrimination lawsuit filed by a former Eastchester police officer.
Anthony Barberan’s suit alleged that he was terminated because he is Hispanic and accused the department harassing him for years.
The town maintained that his firing was a result of insubordination and incompetence.
The judge ultimately agreed, determining that he failed to provide evidence the town even knew of his Hispanic identity.
The town supervisor said the ruling spoke for itself. However, Barberan persisted and sought the now failed appeal.
News 12 is waiting to hear back from Barberan’s attorneys for comment.
