The Yonkers police officer who was seen on tape apparently slamming a woman to the ground appeared Monday in White Plains Federal Court.
A federal indictment alleges that Officer Wayne Simoes grabbed Irma Marquez by the waist, lifted her into the air and slammed her onto the floor.
The government has presented several pieces of evidence in its case, including the officer's personnel file, a 911 radio call and two video surveillance tapes.
Andrew Quinn, Simoes' attorney, says the video doesn't tell the whole story.
"Obviously there was a lot more that happened that night," says Quinn. "The video the government handed over is significantly longer and shows a number of events."
Simoes is expected back in court Dec. 4, when a trial date could be set.
