Elected officials are questioning the arrest of an undocumented immigrant in Pelham Manor.
Carlos Duque was arrested last month after court documents showed he was pulled over for not having adequate brake lights on his vehicle.
Court documents detailed the April 2 arrest, charging Duque, of Larchmont, with two felonies and two misdemeanors – including providing a false name and allegedly possessing a clear pipe believed to have residue of crack-cocaine.
ICE learned of the arrest once Duque was fingerprinted because the prints were entered into a law enforcement database.
ICE officers routinely follow court proceedings of people who may be undocumented with a criminal record. ICE officials told News 12 that Duque has been previously removed from the U.S. in 2008 and 2015.
Elected officials, including state Sen. Alessandra Biaggi and Rep. Eliot Engel, rallied Thursday to advocate for the passage of the Greenlight Bill. The bill, which is under consideration in both the state Senate and Assembly, would allow driver's licenses for undocumented immigrants.
Town officials believe the arrest was handled properly.
Duque remains at the Westchester County Jail until his next court appearance on May 16.
