Regis Foster, 43, was arrested by state police in November after authorities say he “knowingly and intentionally stole” money meant for home instruction last school year.
The case was assigned to a Rockland County prosecutor due to the conflict of interest in Orange County.
Regis remains on the Port Jervis City Council, and has been reassigned to administrative duty within the Port Jervis School District until the outcome of criminal case.
