Middletown police say a man has died after he was assaulted at a gas station last week.
Officers were called to the BP gas station on Wickham Avenue near St. Joseph's Roman Catholic Church last Tuesday. They say they found 31-year-old Daniel Mesa-Rios on the ground, unconscious.
A witness told the officers another man assaulted him then drove off.
Police say as they took care of Mesa-Rio, Jose Vazquez-Rivera pulled into the gas station. They identified him as the suspect who attacked Mesa-Rios and arrested him.
Mesa-Rios was taken off life support this weekend and pronounced dead.
Rivera-Vazquez's charges have been upgraded to manslaughter in the second degree. He’s being held in Orange County Jail.
