Former Tuxedo Park police sergeant given conditional discharge, $250 fine for off-duty Newburgh bar shooting

Prosecutors say the victim was shot in the leg, pistol-whipped and left permanently injured following a verbal altercation between Michael Taback and a woman at the bar.

A former Tuxedo Park police sergeant will not serve jail time for an off-duty bar shooting that injured a man in Newburgh in 2020.

Michael Taback was given a one-year conditional discharge and ordered to pay $250 in fees and fines at his sentencing Friday in Orange County Court for the shooting outside of the Golden Rail Ale House on Old North Plank Road.

Prosecutors say the victim was shot in the leg, pistol-whipped and left permanently injured following a verbal altercation between the victim, Taback and a woman at the bar.

Taback was seen smiling and hugging several people outside of court. His attorney, John Ingrassia, said after the sentencing that his client is ready to “move on.”

“It went as I expected and my client expected. It was a negotiated disposition, and we are pleased the result was reached and moving on,” said Ingrassia.

Taback pleaded guilty to the assault in March after an appellate court ruling overturned the case’s dismissal for timeliness during the pandemic.

Taback was out of duty because of a work injury at the time of the shooting and later put on paid leave. Prosecutors say he is no longer a member of the Tuxedo Park Police Department and moved out of state.

A three-year order of protection was granted on behalf of the victim during the sentencing.
