Robert Durst is scheduled to appear before a judge Monday for a bail hearing after being arrested for the murder of a long-time friend.
Durst was arrested in New Orleans last Saturday and charged with the 2000 murder of Susan Berman, his friend and spokeswoman.
She was killed just before New York investigators were going to question her about the disappearance of Durst's first wife.
The arrest came a day before the the final installment of HBO's documentary about his life. He was recorded in the bathroom saying, "What the hell did I do? Killed them all, of course."
In papers filed Friday at the state Criminal District Court in New Orleans, his lawyers asked a magistrate judge to schedule a preliminary hearing to prove that there is no probable cause to keep the Scarsdale native jailed.
The judge agreed to schedule that hearing on Monday as well.
Durst's lawyers have also been using handwriting on postcards to try to knock down a theory that he was the author of an anonymous letter about Berman's death.
Durst is currently recovering from having a stent put in his head, because of a build-up of fluid in his brain. He has a history of cancer.
