Court proceedings postponed amid fight to keep paroled killer in jail after new misdemeanor charge

Advocates for the Bohovesky family are concerned that despite this history, McCain may be released while the misdemeanor forcible touching case plays out.

The status of a paroled killer in the 1980 murder of a 16-year-old in Rockland County, who was arrested earlier this month in Westchester County is uncertain, with multiple hearings in multiple venues.

Robert McCain, 64, was released from prison in 2021 and was charged earlier this month with forcible touching, accused of groping a woman at a Cortlandt dog park.

A hearing on whether to revoke McCain's parole which was scheduled for Tuesday, but was postponed at the last minute to Aug. 7.

McCain could potentially be released on bail this week because a Westchester County Court judge ruled Monday McCain may be released if he makes bail because he obeyed the terms of his parole.

McCain and Richard LaBarbera were convicted of killing Paula Bohovesky, 16, in 1980, and were released on parole after 40 years.

Advocates for the Bohovesky family are concerned that despite this history, McCain may be released while the misdemeanor forcible touching case plays out.

"We're all trying to tell the local Westchester government, it's up to them," Bohovesky family friend John Murphy said over the phone Tuesday morning, "and they don't seem serious about putting him in jail."

McCain lives in Verplanck and works nearby as a mechanic.

Residents there also have concerns.

"They've got issues," Cortlandt resident Evelyn Horton said of McCain and LaBarbera. "They're not going to be cured of their incidents. He (McCain) is where he belongs."

"He should have never been let go," another resident said. "He should have never seen the streets."

McCain's attorney, Robert Nachamie, said Monday McCain completely denies the forcible touching accusations and that he can prove he is innocent.

Nachamie said he and McCain are ready to advance proceedings to a trial.
