Andrew Krivak was in prison for 24 years until he was released on bail in 2020 after his conviction was overturned.
He and Anthony DiPippo were convicted in the rape and murder of 12-year-old Josette Wright.
Her remains were discovered in the woods in Patterson in 1995.
DiPippo was acquitted in 2016 after his third trial. He settled a lawsuit with the county for $12 million.
The defense says another man committed the crime. Prosecutors say they have enough evidence for a conviction.
