It turns out that mall Santa Clauses are not required to pass a background check before working in New York malls.  
A bill proposed by state Sen. James Skoufis would require employers to run background checks on costumed holiday workers – such as Santa and the Easter Bunny.
Currently, it's up to an employer whether or not a background check is performed.
The new law seeks to crack down on child sex offenders from getting those jobs and would make it a criminal offense for an employer who failed to comply.
