A spokesman for the state Division of Taxation and Finance told News 12 on Monday that the restaurant had been seized Friday.
In a letter obtained by News 12, Kelly said they have reorganized their financial structure under Chapter 11.
He said this will ensure that X2O, Restaurant X and Bully Boy Bar in Congers will remain open and welcoming guests.
