The legal battle over the Harrison Town supervisor's race takes its next step heading to state court Tuesday.
Last month, a state Supreme Court judge ruled Republican Richard Dionisio the winner over independent and former supervisor Ron Belmont and Democrat Mark Jaffe.
Belmont - a write-in candidate - finished on top, but a judge disqualified him. He is appealing the ruling that he had already served the maximum number of years under the town's term limit law.
Jaffee is also seeking a special election between him and Dionisio.
Dionisio was allowed to be sworn into a second term on Jan. 1.
