A judge ruled in favor of Cupcake Cutie Boutique, a cupcake shop that was deemed unsafe and dangerous by the city of Mount Vernon.

The store had been in business for three years but in August, the city ordered it to be shut down. The store owners fought back against the claims in court.

Miesha Starkly, one of the owners, says she believes the city tried to shut down her store due to her stepfather being a vocal critic of Mayor Richard Thomas.

Starkly's stepfather, Damon Jones, is a publisher of Black Westchester.

The judge says the city couldn't explain why it had deemed the store unsafe, and ordered the city to issue a temporary certificate of tenancy until Jan. 10.

If the city refuses to follow orders, then the commissioner must come before the court.

The store has stayed open throughout the court case and a permanent certificate of tenancy is expected to be issued after Jan. 10.
