A group seeking to develop a mosque in the Colonial Heights area of Yonkers has suffered a legal setback.

A federal court judge has rejected a claim by the Islamic Community Center for Mid-Westchester that the city of Yonkers discriminated against them.

The group says Yonkers leaders voted to give landmark status to a Grandview Boulevard mansion only after the group purchased the property.

A spokesman for the Islamic Community Center for Mid-Westchester says they plan to appeal the decision.

In a statement, a city spokesman says Yonkers is willing to work the group. “As previously said, the ICCMW is welcome to open a mosque at their desired location in the city. It's unfortunate they continue to prosecute this meritless case when they can be spending their time working with the city of Yonkers, which stands ready to help them in their efforts in providing a place of worship for their congregation,” says corporation counsel for the city of Yonkers Michael Curti
