The Department of Justice has dropped its case against a Capitol riot defendant from Rockland County.
Christopher Kelly, from New City, was accused of entering the U.S. Capitol on Jan. 6.
He was taken into custody after a confidential source told the FBI about Kelly's social media posts, but none of his photos showed him actually inside the building.
His case has been dismissed without prejudice.
News 12 received a
statement from Kelly's attorney, Edward MacMahon. "I am pleased
that the government has dropped all charges against Mr. Kelly," he said.
"He never entered the Capitol on January 6 and that is precisely what he
told the government before he was arrested. I hope Mr. Kelly can go back to
work and start to rebuild his life."
