The defense in Narcy Novack's murder trial is trying to get statements she made to police thrown out due to allegations that her rights were violated.
Novack stands accused of plotting the murder of her husband, the millionaire Ben Novack, in the summer of 2009.
In a motion filed at the federal court in White Plains, the defense alleges that police interrogated Novack for 13 hours straight without access to a bathroom, food or a phone, and failed to advise her of her rights.
If convicted, Novack and her brother, Cristobal Veliz, who is accused of helping her in the murder, could spend the rest of their lives in prison.
The trial is expected to begin April 16.
