David Mosley sentenced to maximum two years in jail for animal cruelty case

Two years is the maximum sentence allowed for the offense under New York’s Agriculture and Markets Law.

David Mosley was sentenced to two years in local jail after pleading guilty to aggravated cruelty to animals Monday.

Mosley is also banned from owning or obtaining animals for 10 years. After completing his sentence, he will not be subject to continued supervision because the law does not provide for it in this case.

During sentencing, the judge addressed the limitations of the law and discussed other potential legal avenues that could have resulted in a longer sentence. A sentence of up to seven years had been considered in connection with the extent of the property damage.

However, Mosley pleaded guilty to the aggravated animal cruelty charge. Other potential options included taking the case to trial or seeking a new indictment incorporating additional charges.

Two years is the maximum sentence allowed for the offense under New York’s Agriculture and Markets Law.

Mosley did not make a statement at sentencing. His attorney told the court that Mosley understands what he did was wrong, regrets his decisions, accepts responsibility and does not minimize his actions. Mosley also indicated that he wants mental health treatment, and the judge said resources would be available to him while incarcerated.
