The election for the 35th Senate District may have ended, but the legal fight is just getting started.
With all the precincts now reporting, Democrat Andrea Stewart-Cousins is ahead with 51 percent of the vote over incumbent Senator Nick Spano?s (R-Yonkers) 49 percent. That is a lead of more than 2,100 votes. Lawyers for Spano and Stewart-Cousins were back in court Thursday trying to decide how to proceed with a recount. They set the schedule for re-canvassing the votes in the machines. There are also thousands of paper ballots to be tallied.
Two years ago, Spano won by just 18 votes in the longest recount in state history. This time, however, Spano has more ground to make up with Stewart-Cousins leading with machine tallies. On Monday, the Board of Elections should know exactly how many paper ballots are in question. Spano?s attorney says perhaps then Spano will make a decision on how to proceed.
