One of the men shot over the weekend by an off-duty Mount Vernon police officer is out of the hospital.

Mark Nembhard, 34, says he was shot in the foot after attending a party on South 4th Avenue. At the party, Nembhard says he noticed the off-duty officer fighting with another guest when the officer pulled out a gun and started firing it.

Nembhard says he was caught in the crossfire and is now experiencing a great amount of pain as he recovers from his injuries.

"i just left my kids when I went up to the party...An hour or two later, they [were] at the hospital crying,” he said. “That…breaks my heart."

Nembhard says his brother was also shot by the officer and remains in the hospital.

New York State Police, which is handling the investigation, confirmed that the shooting incident involved an off-duty member of the Mount Vernon Police Department. Details regarding the officer’s involvement have not been released.
