Greenburgh officials, residents urge new ShopRite to stop early-morning delivery trucks

According to the town building inspector, deliveries to this store are restricted to the hours of 7:30 a.m. to 8:30 p.m. Monday through Saturday, and 10 a.m. to 4 p.m. on Sunday.

Residents and officials in Greenburgh are urging a new grocery store in the neighborhood to comply with the town’s rules of delivery hours and minimize excessive noise overnight.

When ShopRite opened on Saw Mill River Road in March, residents welcomed it.

"We were hopeful that this was going to be a good addition to our neighborhood,” says resident William Anderson.

However, Anderson, who lives behind the store, says he has been hearing delivery trucks coming as early as 1 a.m.

“It's been horrible…I’ve had very little sleep the last couple months,” he says.

According to the town building inspector, deliveries to this store are restricted to the hours of 7:30 a.m. to 8:30 p.m. Monday through Saturday, and 10 a.m. to 4 p.m. on Sunday.

The Town of Greenburgh has issued multiple violations, and most recently a summons.

"Our building inspector has made surprise visits early in the morning. Last week. he was here at 5:30 a.m. and caught them and issued a summons,” says Town Supervisor Paul Feiner.

He says the summons issued on Monday resulted in a $300 fine for ShopRite.

Feiner told News 12 if ShopRite does not comply with delivery hours, the town will not issue a certificate of occupancy needed to operate and could revoke the current temporary certificate of occupancy.

“They have to realize that the town is serious, that when we make a commitment to the community, we expect to keep the commitment,” he says.

Anderson adds, “What I really want is sleep.  I don't want to call the cops, I don't want to write to the town, I don't want ShopRite to go to court. I want to be able to sleep.”

A spokesperson for ShopRite told News 12 the grocery chain has resolved three violations issued for off-hour deliveries and they've reminded vendors of proper delivery times to ensure it doesn't happen again.

The spokesperson added, “As a new business in the area, we are committed to serving the community and addressing any concerns from our neighbors."
