An appellate court has reinstated an indictment against a Tuxedo Park police sergeant in an off-duty shooting at a Newburgh bar.
Michael Taback was charged with assault following the October 2020 shooting outside of the Golden Rail Ale House in Newburgh.
The indictment was later dismissed in Orange County Court due to claims he had been deprived of his right to a speedy trial.
However, an appellate court reversed the ruling, pointing out that Gov. Andrew Cuomo signed an executive order which temporarily suspended certain speedy trial clocks in the midst of the COVID-19 pandemic.
The DA’s office argued that they had complied with the requirements for a speedy trial under the executive order.
The ruling means the case is back in County Court for further proceedings.
At the time of the shooting, Taback has been on leave due to a line of duty injury.
