Three charged with assault in beating of NYPD officer from White Plains
Police have charged three men in connection with the beating of an off-duty NYPD officer that took place just before he was shot by a fellow officer over the weekend.
According to police, five men beat Officer Eric Hernandez, of White Plains, while he was on line at a White Castle in the Bronx. Police released the surveillance tape showing the attack and received tips that led to the arrest of Nelson Rodriguez, Edwin Rivera and Daryl Massey. The three Bronx men are charged with first-degree attempted assault and second-degree assault.
Following the attack, Hernandez made his way to the parking lot where he drew his weapon and pointed it at a man he thought was one of his attackers. Police believe the attack left Hernandez dazed and unable to identify himself as an officer when police arrived. Witnesses say when police told Hernandez to drop his weapon he turned towards them with his gun in hand. That's when Officer Alfredo Toro fired, hitting Hernandez three times. NYPD Police Commissioner Ray Kelly said after a review of the shooting, Officer Toro followed department procedure and acted according to NYPD guidelines.
Hernandez, 24, is still in critical condition at Saint Barnabas Hospital. A hospital spokesperson says doctors amputated his lower left leg at the knee.
Meanwhile, police are asking anyone with information on the other two suspects to call Crime Stoppers at 1800-577-TIPS.
