Police: Amityville man drove drunk with son, daughter in back seat
An Amityville man was arrested and charged with a felony Sunday night for allegedly driving drunk with his two children in the car.
Police say an officer spotted 43-year-old Shem McCoy rolling through a stop sign on Countyline Road in Massapequa just before 8 p.m. He then allegedly swerved into oncoming traffic to pass another car.
They followed McCoy and pulled him over a few feet away from the driveway of his apartment complex. Police say his eyes were bloodshot, his speech was slurred and that he smelled of alcohol.
Officials say McCoy's 10-year-old son and 7-year-old daughter were in the back seat. According to court documents, his blood alcohol content was .13 two hours after he was pulled over.
The Amityville man had previously served prison time for a fatal shooting outside Amityville High School in 1993 when he was 17. McCoy shot two teens and was convicted of manslaughter for the death of one of them.
In the most recent incident, McCoy was arrested under Leandra's Law, which is a state law making it an automatic felony on the first offense to drive drunk with a person age 15 or under in the car.
Anti-drunk driving advocate Marge Lee says the law has been a deterrent, but that incidents like these still happen.
"The thing that upsets me the most is we have to have a Leandra's Law in the first place," Lee said. "As parents, our job is to protect our kids. Hurting or killing your child, it's unimaginable."
The children were turned over to the custody of a relative.
McCoy's license was suspended. He was held on $2,000 bond at his arraignment Monday.
