Rye Brook lab error led to unnecessary mastectomy
A Rye Brook medical testing company is being sued by a 35-year-old woman who was mistakenly told she was dying of breast cancer.
Darrie Eason, of Long Beach, Long Island, was given a diagnosis of invasion lobular carcinoma last year after a breast biopsy. Four months later and after Eason underwent a double mastectomy, she was told her tissue sample had been mislabeled and that she never had cancer.
It was a technician working at CBL Path in Rye Brook that apparently made the tragic mistake. ?The report was not attached to the correct patient. In a certain sense, this is the simplest of medical errors to understand and yet it happened," says Eason?s attorney.
According to the state health department, that worker at CBL admitted to cutting corners and incorrectly labeling tissue specimens. He was let go from his job.
Two weeks ago, Eason filed a lawsuit against CBL Path in state Supreme Court seeking an undisclosed sum of money. Her lawyers claim the lab and its technician were both careless and negligent.
In addition to Eason, there is also an unnamed victim who was told she was cancer free and then later told she had cancer.
