'Glenn McElroy Bill' allowing judge to withdraw health care proxy clears NY Assembly, Senate
Leaders announced today that the Glenn McElroy Bill was passed unanimously by the state Assembly and Senate.
Glenn McElroy died in January 2010 after his wife ran him over outside a restaurant in a drunken rage.
She pleaded guilty to vehicular manslaughter and DWI, and the 27-year-old was kept alive on life support in the hospital for nearly a week. Despite being the prime suspect, his wife still had authority over his health care.
The new legislation would allow a judge to withdraw the health care proxy if the person is charged with harming the victim. Assemblyman James Skoufis led the battle for the bill's passage.
Supporters wore buttons with McElroy's picture on them.
The victim left behind an 8-year-old son. His heartbroken family says closure is hard to come by, but this brings something positive out of their loss.
According to the Department of Corrections, Kelly McElroy was released on parole in December 2012. McElroy's family members believe she is living with her mother in town.
It is unclear at this time exactly when Gov. Andrew Cuomo will sign the bill.
