Family of man who fell out of window files lawsuit
The family of a Yonkers man who fell out of a window during a drug raid last year has filed a wrongful-death lawsuit against the city and members of its police department.
In March 2014, Dario Tena died after falling from his third-floor apartment on School Street in Yonkers during a drug raid, which was based on a bogus search warrant.
Former Yonkers Police Officer Neil Vera and Detective Christian Koch admitted to lying to get the warrant, but were never charged in connection with Tena's death.
Tena allegedly fell backward out of his window. His sister, Maria Tolentino, is now filing a lawsuit to find out exactly what happened.
Tena's family says that filing the lawsuit is just their first step toward justice. They will be asking the attorney general's office to conduct its own investigation into Tena's death.
The city of Yonkers has said in a statement, "A thorough probe by the Yonkers Police Department uncovered no evidence that would suggest any wrongdoing in relation to Mr. Tena's death."
A spokesperson from Westchester County District Attorney Janet DiFiore's office told News 12 that he could not comment because there is still a criminal case pending against on the officers involved.
