Westchester judge warns contractor over incomplete community service in fatal trench collapse case

Tensions flared at Westchester County Court on Friday as it came to light that contractor Michael Conway who was charged in the 2021 trench death of a laborer did not fufill his end of the plea deal.

Westchester County Court Judge Maurice Williams expressed frustration after learning that Michael Conway had completed only 66 of his required 150 community service hours.

Conway pleaded guilty to second-degree reckless endangerment in connection with a fatal 2021 accident at a residential construction project in Mamaroneck.

Jose Vega, 46, was working at the site when an unprotected 9-foot trench collapsed, burying him.

As part of his plea deal, Conway — a contractor on the project — agreed to stay out of trouble for a year and complete the 150 hours of community service during that time.

Prosecutors said Conway still has not completed 84 hours, despite having more than a year to finish them.

They asked that he be sentenced Friday to a year in the Westchester County Jail.

However, Williams gave Conway until March 23 to complete the hours.

“I’m telling you right now, come the 23rd of March, if the community service is not completed, I am prepared to impose sentence on said date,” Williams said.

Conway and his attorney declined to comment.
