Suspects may face upgraded charges in beating of NYPD officer from White Plains

An autopsy is scheduled for 24-year-old NYPD Officer Eric Hernandez, from White Plains, who died Wednesday from injuries sustained after being beaten and then shot by a fellow officer in a case of mistaken identity.
A grand jury is hearing evidence on six suspects who were formally charged with gang assault in the beating of Hernandez at a White Castle in the Bronx on January 28. Following the attack, Officer Alfredo Toro, of Washingtonville, shot Hernandez when he was pointing a gun at a man he thought was one of his attackers.
Pending the autopsy results, the grand jury may decide to upgrade the charges on the six suspects. Hernandez died after being taken off life support.
