Thursday was day four of the trial against the Garnerville man accused of strangling his girlfriend to death last year.
Nixon Bourguignon, 37, is charged in the death of his girlfriend Shannon Coleman at the apartment they shared in May 2014.
The trial got off to a slow start because Judge William Kelly had to take care other cases on his calendar.
When the trial did resume, lawyers told the jury that Bourguignon told a Haverstraw police detective that he had taken the sleep aid Ambien the night Coleman died.
Bourguignon's lawyer admits his client strangled Coleman, but says Bourguignon was unaware of what he was doing because he was under the influence of the drug.
The prosecution contends Ambien played no role and that Bourguignon was angry because Coleman threw him out of their home in Garnerville.
The trial is expected to last through next week.
