According to the U.S. Attorney's Office, Bauduy and Richard are "convicted felons who engaged on a busy Brooklyn street in broad daylight."

They had both been released from prison earlier this year - Bauduy in June and Richard in April.

Bauduy and Richard allegedly were in a gunfight along Ocean Avenue, just before 7:30 p.m. on Aug. 12.

Officers arrived and observed the gunfight in progress and recovered a gun that had been used by Bauduy at the scene.

Both defendants have prior firearms convictions that prevent them from legally possessing guns or ammunition.
