The state pause on evictions has a Sullivan County trustee in some legal trouble after ongoing tensions with a tenant landed him under arrest.

A video shows Monticello trustee and landlord Michael Banks, 46, allegedly yelling at his tenant, Jasmine Negron. Police have arrested Banks for trespassing.

Negron says she recorded the exchange in September and is heard screaming at the landlord to get out of the house.

Negron, who has four children, has been unable to pay her rent since her mother moved in September. She is involved in a bitter eviction dispute with the trustee.

The dispute is on hold until January due to a statewide COVID-19 pause on evictions.

Negron says she's looking for work and offered to give partial payment to continue the lease. Banks says Negron was never on the lease, and expressed frustration with Gov. Andrew Cuomo's pause on evictions, saying the entire situation "is a mistake."

New York's moratorium on evictions was signed into law in March and was extended until Jan. 1.

Banks was charged with misdemeanor trespassing and given an appearance ticket to return to court.
