A federal judge has declared a mistrial for two of the three defendants in the "Corridor of Corruption" case.

The mistrial was declared for state Sen. Malcolm Smith and former Queens Republican leader Vincent Tabone. The judge made the decision because the defense needs more time to process several days' worth of surveillance audio turned over by the prosecution last week. Prosecutors say they only handed the tapes over to the defense now because they thought they were not relevant.

More than half the audio is in Yiddish and needs to be translated. The trial then would have lasted until the middle of July, but not enough jurors were able to serve that long.

Former New York City Councilman Daniel Halloran will still be tried and his case will resume next week. The new trial for Tabone and Smith will start in January.

Smith is accused of trying to bribe his way onto the Republican ballot for New York mayor last year.
