The handcuffs have been removed from a 14-year-old in the hospital after being critically injured during an arrest last weekend, according to the Rev. Al Sharpton and the National Action Network..
Javier Payne is recovering at Jacobi Medical Center after going through a glass storefront on Arthur Avenue Saturday.
According to police, the teen was being taken into custody for assaulting a man who refused to give him and another teenager a cigarette. They say he pulled away and accidentally fell through the glass window.
However, the boy's family argues that he was unnecessarily thrown through the window. They plan to meet with Sharpton this weekend to demand the officers involved be prosecuted.
"We look forward to the Bronx district attorney conducting an independent investigation with regards to what happened here and the issue of criminality and this police officer," says Payne's lawyer, Sanford Rubenstein. 
Rubenstein also says that Javier and his family are cooperating with internal affairs.
