The father and son charged in the death of two people during a fire in a Spring Valley adult home want their homicide indictments thrown out.

Rockland County Judge Kevin Russo said Wednesday in court that he needs another few weeks to consider the defense's motion to dismiss those charges.

Prosecutors say Nathaniel and Aaron Sommer were cleaning a kitchen at the Evergreen Home for Adults with a propane torch, which started a large fire in 2021. The Sommers are charged with one count each of manslaughter, negligent homicide and assault.

Spring Valley firefighter Jared Lloyd and Oliver Hueston, a resident of the home, died in the fire.

Lloyd's parents say that despite this delay, they're still fighting for justice. "Jared was my only child. The hole is still in my heart. But I’m learning to rebuild my life without him, through being his advocate for justice. That's my theme: Justice for Jared," says Jared’s mother Sabrial

The judge says he plans to issue a written ruling on their motion to dismiss charges at a new hearing scheduled for Sept. 28.
