Former Briarcliff Manor police officer Nicholas Tartaglione is asking that be transferred to a different prison.
Tartaglione is charged in a quadruple slaying in Orange County nearly four years ago.
He's been held at the Metropolitan Correctional Center in Manhattan ever since his arrest.
In a letter to a judge, Tartaglione's attorney says the facility has proven it can’t provide a safe, clean environment for his client, who faces the death penalty.
This is at least the second request his attorney has made to move him to another facility.
