A man serving time for the 1996 murders of an Eastchester millionaire and his caretaker could be headed back to trial for a fifth time.
Selwyn Days' conviction for killing millionaire Archie Harris and his caregiver was overturned by a state appellate court.
According to court documents, the conviction was overturned because of the ruling made by the Westchester County court in 2011 to bar expert testimony on the issue of false confessions.
Attorneys for Days said their client had confessed under duress, and stated that the judge in the case did not allow them to call a false confession expert.
Now, Days could be going to trial for a fifth time.
"We are thrilled with the decision. It's the right result. He deserves a fair trial and hasn't had one yet. It's been a long, long road for Selwyn to prove his innocence and this brings him closer one step to freedom," said Rebecca Freedman, the attorney representing Days.
District Attorney Janet DiFiore, through a spokesperson, said she would review the decision but hadn't decided on the next step.
