A federal jury in White Plains heard two very different versions Tuesday of what happened on a surveillance video that captured a confrontation in Yonkers between a woman and a police officer.
Federal prosecutors say the video shows Officer Wayne Simoes crossing the line and willfully using excessive force on Irma Marquez. The defense says if the tape is slowed down, it shows an accidental slip by an officer who was trying to subdue an aggressive drunken woman on March 3, 2007.
Both sides made their arguments during closing arguments in Simoes' trial. Pictures taken after the incident show Marquez's face badly bruised and with a broken jaw. The defense says Simoes slipped when he tried to grab Marquez, who they claim was falling down drunk, and that they both crashed to the floor accidentally.
