A Peekskill police officer was caught on camera punching, kicking and tasing 42-year-old Damar Fields during an arrest at the Riverfront Green Park Gazebo on Dec. 3.
Charges have not been filed nine days later.
The incident has raised questions and concerns in the community.
"The police body camera tells a different story. Mark my words: If that video would've helped that cop, they would have released it on day 1. Why hasn't it been released?" said civil rights activist and community member Darrell Davis. "The second glaring question is: When have you known someone to assault a police officer and nine or ten days later, they're still not charged?"
Court officials say the documents may be ready by Monday.
Earlier this week, Chief Adam Renwick said that he will ensure any mistakes made during the incident are identified and that future training is designed to prevent them from occurring again.
The officer who initially responded has been placed on administrative leave while the District Attorney's Office investigates.
