An asylum seeker who spent nearly three years in ICE custody in New Jersey has been released.

White Plains attorneys Steven Haskos and Craig Relles say their client Adou Kouadio's release is a victory for immigrant rights. They say jailing an asylum seeker for that length of time without a hearing is unjust.

Kouadio arrived at the Texas-Mexico border in 2016 to seek asylum from his home country.

Haskos and Relles argued before a federal judge in Manhattan in late December that the Ivory Coast man's due process rights were being violated.

A federal judge ruled that freedom from imprisonment -- from government custody, detention, or other forms of physical restraint lies at the heart of the liberty that due process protects, even with respect to detainees who have no legal right to be present in the United States.

Kouadio is now out on bail. His application for asylum is still being considered.
