A local assemblyman wants to repeal a new law that allows suspects in most misdemeanors and nonviolent felonies to walk free without posting bail.

Assemblyman Colin Schmitt, of Orange County, announced he is drafting legislation to repeal the law, which he says puts criminals back on the streets - because judges are now barred from setting bails for misdemeanors and nonviolent felonies including burglary, drug offenses and robbery.

While some argue cash bails are unfair to the poor, Schmitt says he worries the new law allows dangerous criminals to go free - and possibly avoid prosecution.

The next legislative session begins on Jan 8. Schmitt says this issue is one of his top priorities.
