Mount Vernon Mayor Richard Thomas has filed a lawsuit claiming the acting administration is illegally performing governmental duties.

Mount Vernon Mayor Richard Thomas has filed a lawsuit claiming the acting administration is illegally performing governmental duties.

The suit, filed in state Supreme Court, alleges that acting Mount Vernon Mayor Andre Wallace is breaking the law by taking such actions such as writing checks and firing employees.

"These actions are illegal, unnecessary, disruptive, embarrassing, and directly interfere with the day to day operations of municipal government and my ability to discharge my statutory duties as Mayor," says Mayor Thomas. "The unnecessary confusion has also injured the City's ability to conduct business. We will not tolerate immature extremists interpreting the law at the expense of the people."

PBA President Brent Gamble claims the chaos has begun to affect police officers and disrupt order in the city. Gamble is asking that Gov. Cuomo step in to rectify the situation.

Wallace says he wants to move forward, writing in part: "Mr. Thomas is now a private citizen with no right to seek the relief he's asking for. We look forward to making this clear to the court."

Wallace and Thomas will come face-to-face in state Supreme Court Friday.
