Judge rules in favor of Dunkin' expansion in Stony Point

It's back to the drawing board for residents in Stony Point after a judge ruled that the town's planning board acted properly when it approved a Dunkin' coffee store to triple in size.

It's back to the drawing board for residents in Stony Point after a judge ruled that the town's planning board acted properly when it approved a Dunkin' coffee store to triple in size.
Neighbors of the Dunkin' on Willow Grove Road in Stony Point say the business is too bustling and increasing the size will make traffic worse than it already is.
The Dunkin' was approved by the planning board last year to triple in size.
Attorney Kevin Conway sued the planning board on behalf of residents, arguing the board didn't follow proper procedure when it approved the expansion. But last week, a judge ruled in favor of the board.
Attorney Stephan Honan represents the town's eight-person planning board. He says the Dunkin' expansion includes a new traffic flow that would make it safer than it is now, even with more people and cars.
Residents say that if the Dunkin' gets bigger, it would become an even bigger attraction to students at North Rockland High School, which is only about a half-mile from Dunkin'. Residents say the number of kids who go there is already a problem.
Conway says the site's new traffic plan will not make it any safer.
"It's a fantasy to think the traffic is going to be improved because it can't handle the traffic right now," says Conway.
An attorney for the residents who sued the Stony Point planning board say they're considering filing an appeal against the judge's decision.
There is no word yet on when construction might begin on the new site.
