The Mamaroneck Ralph’s Italian Ices on Boston Post Road has been given one week to close after being denied a special permit to remain open by the Mamaroneck Zoning Board of Appeals.
News 12 is told there has been an ongoing controversy between the store and some community members who are concerned about safety and noise.
“Our main objective is to keep the kids and the community members safe here,” said one resident who lives nearby.
The store’s owner, Scott Rosenberg tells News 12 he reconfigured the parking lot, put extra employees on shift to keep lines down and even hired a parking attendant to ease concerns and make sure everything was safe.
Rosenberg says the situation all began after a mix-up with the buildings department that allowed him to open as a retail location instead of fast food.
Mayor Norman Rosenblum calls the situation “unfortunate” because the case could now head to court.
