A state supreme court judge has ruled that Scott Smith can remain on the "Serve America Movement" and Libertarian party lines in the 18th Congressional District race.

A state supreme court judge has ruled that Scott Smith can remain on the "Serve America Movement" and Libertarian party lines in the 18th Congressional District race.
Republican candidate Chele Farley said Smith was not entitled to the Libertarian line because he changed his party's affiliation.
Smith agreed with Farley and placed the blame on the New York Board of Elections.
The judge did agree, but said it was too late to remove his name from that line.
Incumbent Democrat Sean Patrick Maloney is the third candidate in the race.
