Clarkstown Town Supervisor George Hoehmann won a lawsuit against the town to overturn the term limit law.
An appellate court has overturned a lower court ruling that denied the Republican his attempt to run again.
The court ruled that the Town Board did not properly adopt the term limits law because residents did not vote on it during a public referendum.
The state Court of Appeals said it would hear an appeal of the ruling.
Two Clarkstown council members are challenging the town board's vote to void term limits.
